2. Beta; No Professional Advice
The Services are in beta and may change or be unavailable. AI outputs can be inaccurate. Do not rely on outputs for medical, legal, financial, or safety-critical decisions.
3. Eligibility
You must be 16+ (or the age of digital consent where you live). If you use the Services on behalf of an organization, you represent you're authorized to bind that organization.
4. Accounts & Security
You're responsible for your account, credentials, and all activity. Notify us of suspected unauthorized use at contact@xoxo.ai.
5. Acceptable Use
You will not: (a) break laws or third-party rights; (b) upload malware or interfere with the Services; (c) use the Services for exploitation, harassment, disinformation, or other harmful/illegal conduct; (d) reverse engineer, scrape, or crawl except as permitted by law. We may suspend or terminate for violations.
6. Your Content; License to Operate the Services
You retain ownership of content you submit ("User Content"). You grant XOXO AI, Inc. a non-exclusive, worldwide, royalty-free license to host, process, and display User Content solely to provide, maintain, and improve the Services. You're responsible for necessary rights and consents to upload User Content.
7. AI Outputs & IP
Subject to these Terms and applicable law, you may use AI outputs you receive. Outputs may be similar to outputs provided to others. You are responsible for ensuring your use complies with law and third-party rights.
8. Feedback
If you provide feedback, you grant XOXO AI, Inc. the right to use it without restriction.
9. Privacy
Our Privacy Policy explains how we handle information.
10. No Training on Your Content (Default)
Unless you explicitly opt in, we do not use your User Content to train foundation models. We may use aggregated, de-identified statistics to improve the Services.
11. Third-Party Links
The Services may link to third-party sites. We're not responsible for their content or practices.
12. Warranty Disclaimer
The Services are provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties, express or implied.
13. Limitation of Liability
To the fullest extent permitted by law, XOXO AI, Inc.'s total liability for all claims related to the Services is the greater of USD $100 or the amounts you paid to XOXO AI, Inc. in the 12 months before the claim. We're not liable for indirect, incidental, special, consequential, or punitive damages.
14. Indemnification
You will indemnify and hold XOXO AI, Inc. and its affiliates harmless from claims arising out of your User Content or misuse of the Services.
15. Changes
We may modify the Services and these Terms. We'll update the effective date and, for material changes, provide notice. Continued use means you accept the changes.
16. Governing Law; Venue
These Terms are governed by the laws of California, excluding conflict-of-laws rules. Exclusive venue is in the state or federal courts located in San Francisco County, California.
17. Termination
You may stop using the Services at any time. We may suspend or terminate access for any reason, including violations of these Terms. Sections that by their nature should survive will survive.
